Let's see... Your girlfriend was an illegal in the US and left on her own. How long was she in the US and did she ever get stopped by police or go into any government office to apply for any thing? If her name isn't on any US government info list anywhere then she wasn't really ever in the US was she?

If she can account for her time in Mexico then you might be OK.

1. Get engaged and apply for a fiance visa. It's quicker than a marriage visa.
2. Get married in Mexico and apply for a spousal visa.
3. If she gets a tourist or student visa (I really doubt that if she was illegal in the US in the first place) then you guys get married in the US and apply for a change of status.

BTW just because you're a US citizen doesn't mean you have the "right" to bring her to the US. You gotta apply. If it's true love, it can be done, but it'll take a long time and it's expensive.

Good luck!

Under no circumstances would you be able to bring her back as a US citizen. She first has to obtain legal residency, then after a period of years, she can apply for citizenship.

You should apply for a waiver to allow her to re-enter the US since she has been in the US illegally and it does not matter that she left on her own. If you withhold the information that she has been in the US illegally, it will be considered fraud. Lying on immigration forms can be prosecuted for perjury.

You can apply for a fiance' visa, or you could marry her, return to the US and sponsor her to come to the US as your spouse. She cannot re-enter the US until she receives one of those visas and the waiver.

Ha ha, no this is an armature question, of course not. She must be a citizen, i mean i'm sure she can visit. But if you want her to stay, she has to become a US citizen, and if you want to marry, you'll have to marry within about 3 months.

If you get married in Mexico you can come back, alone, and file an immigration petition for her. It will take about 12 to 18 months before she gets the visa.

She'll most likely need a waiver due to her illegal stay in the United States.

In a case like this you'll almost certainly need an immigration attorney to assist you.

******It doesn't matter if she left on her own. The US embassy will require her to account for her whereabouts. If she lies, and they catch her in the lie, they'll ban her from the USA for the rest of her life due to attempted visa fraud.

Do it legally. Get the waiver and she'll have nothing to worry about.
